The Functional Assessment of Capacity

Course Details

This courses facilitates an in – depth exploration of the guiding principles of the Assisted Decision Making  (Capacity) Act  2015 (as amended) and the functional assessment of capacity. It provides participants with the skills and knowledge required to assess decision making capacity and focuses on the importance of building capacity and using the assessment process to determine the person’s will and preference and supports required to make their decision.

A key component of this course is the practical application of the law, participants are encouraged to work through typical examples of cases they encounter on a daily basis. The course content is based on the Codes of Practice of the Act, peer reviewed articles and case law from Ireland. In addition case law is also explored from the jurisdiction of England and Wales entailing examples of good practice in building and assessing capacity as identified by presiding judges. The course importantly gives participants the skills, knowledge and confidence to stand over a robust assessment of capacity according to the standards set out in law.

On completion of this course participants will be able to:

  • 1. Recognise what the term ‘Next of Kin’ means.
  • 2. Identify the difference between the status, outcome and functional approaches to decision making capacity.
  • 3. Understand the relevance of the Codes of Practice associated with the Act.
  • 4.Have the skills and knowledge to apply the nine guiding principles of the Assisted Decision Making (Capacity) Act to the assessment process.
  • 5. Understand when the question of capacity should be raised.
  • 6. Understand the importance of the following statement and learn strategies for acting on this. “A person is not treated as unable to make a decision unless all practicable steps to help him to do so have been taken without success.”
  • 7. Recognise who can assess decision making capacity.
  • 8.Understand the importance of preparation for an assessment including the importance of seeking a person’s consent to the assessment.
  • 9.Explore examples of questions to ask when assessing each part of functional capacity.
  • 10.Understand the importance of using the functional assessment to determine the nature of decision making assistance required.
  • 11. Examine real life, practiced based situations in which capacity has been assessed and learn from those situations.
  • 12. Examine how to record the assessment process and follow up work required thereafter.
  • 13. Know how to manage the outcome of an assessment.
  • 14.Be aware what to do if a person refuses to participate in an assessment.
